Below are the terms and conditions of use that govern your use of the "KaKtu" site, including without limitation the website www.kaktu.al , and the posting, editing, display or search of any posting on KaKtu, as well as any of its products or services.
By accessing the KaKtu Website, regardless of the form: on mobile, tablet, or any other medium or platform, you agree to abide by these terms, as they may be amended from time to time.
Definitions
Capitalized words have the meanings set forth in the Terms below. The following definitions shall have the same meaning whether appearing in the singular or plural. Definitions For the purposes of these Terms:
- Country means: Albania.
- The Service is providing the opportunity to post, search, view, and contact real estate buyers on a platform that collects all real estate properties. The Service refers to the KaKtu Platform
- Service Providers or Third Party Service means any service or content (including data, information, products or services) provided by a third party that may be displayed, included or made available through the Service.
- Website refers to the KaKtu website, accessible at https://www.kaktu.al.
- You means the person accessing or using the Service, or the company, or any other legal entity on whose behalf such person accesses or uses the Service, as the case may be.
- Publication is any unit of information about a specific property/object that is placed by you, or automatically reposted by the KaKtu Platform system.
Acknowledge/Acceptance
These Terms set forth the rights and obligations of all users for the use of the Service. Your use of the Service is conditioned upon your acceptance and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
Making publications/searching publications
If you wish to use the Service, you will be asked to provide certain important information about your property, including, without limitation, your first and last name, your email address, your telephone/mobile number, and your Country of origin and/or the country from which you are posting. You represent and warrant that: (i) the information you provide is true, accurate, and complete. We will treat all such information as strictly private and confidential and will take all steps reasonably necessary to maintain its confidentiality. We will not use, copy, or store any such information on an externally accessible computer or similar system, nor will we transmit it within or through any such system. We will use such information for the permitted purpose and for no other purpose and in particular, but without limitation, we will not use any such information in order to gain any commercial advantage over the Company.
We will maintain a record of the information provided to us and other persons to whom such disclosure has been made, and the location of such information and of any person in possession of such information.
Availability, Errors and Inaccuracies
We continually update announcements received while using the Platform. Listings displayed on our Service may be incorrectly priced, inaccurately described, or unavailable, and we may experience delays in updating information regarding Announcements and our advertisements. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Pricing Policy
The prices quoted are set by users and are not subject to review by the Company after approval of an Announcement. In the event of any event affecting the publication of the Announcement caused by government actions, changes in duties, tariff increases, higher foreign exchange costs and any other matter beyond the control of the Company.
Intellectual Property/Content Ownership
The Service and its original content (excluding Content provided by You or other users), features and functionality are and shall remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark and other laws of the country and foreign countries. In particular, all text, page titles, technical documentation, images, photographs, designs, graphics, logos, button icons, scripts, service names, product data, visual interfaces, trademarks, sounds, music, videos, broadcast content, computer programs and artistic works, including but not limited to the design, structure, selection, coordination, expression contained in the Service is owned or controlled by Us, or is licensed by Us, and is protected by copyright, patent and trademark legislation as well as various intellectual property rights and competition laws. The trademarks may not be used in connection with any product or service without the prior written consent of the Company. All other trademarks not owned by us that appear on the Service are the property of their respective owners, who may or may not be affiliated with, affiliated with, or sponsored by Us. We may change the content and features of the Service at any time. You may not copy, use, republish, download, post, publicly display, transmit, reproduce, or distribute in any way the Content (or any portion thereof) in any manner without our prior written permission, except as expressly permitted by the Terms.
In Announcements whose content is taken from other platforms by an automatic system, KaKtu in no case copies the posted materials, but uses a cache component that only temporarily stores the data for the purpose of displaying them to the user. The original content can only be found on the originating site, which is responsible for the authenticity and accuracy of the data as well as the rights to use the content.
Data subject rights
You consent to the processing of your personal data such as: first name; last name; email address; telephone number; address; and gender, for the purpose of:
- its processing ensures the security and availability of our services;
- improve our services and communication channels;
- marketing and other customer relationship purposes;
- contract management;
- communication and social media;
- service billing;
- audit, control and review.
Personal data is processed and stored securely by authorized employees of KaKtu and will be destroyed upon completion of a period of five years from the moment of their collection. The data subject, or an authorized representative, has the right at any time to request a copy of the personal data, to request their correction, and if necessary, the deletion of the data. The data is automatically deleted after a period of 5 years from their collection, if the user is no longer active on the Platform.
Photographs, Images and Audiovisual Recordings
You transfer all right, title and interest in and to any Announcement you post to KaKtu. If for any reason such transfer is ineffective, You agree to grant to the Company a worldwide, royalty-free, irrevocable, perpetual and non-exclusive right and license to reproduce, display, sublicense, distribute, modify and exploit such Submissions without restriction.
Links to other Internet sites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be liable, civilly or criminally, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services. We advise you to read the terms and privacy policies of all third-party websites or services linked through Posts displayed on the KaKtu Platform.
Termination of the Right to Service
We may terminate or suspend your access immediately, without liability or prior notice, for any reason, including without limitation if you breach these Terms. Upon termination of your access, your right to use the Service will immediately cease. You may send an email requesting reinstatement of your right to use the Service within 30 days of receipt of the email notification that your access has been suspended, explaining the reasons why you should be allowed to use it. It is at the Company's discretion to decide whether to reinstate your access.
Limitation of Liability
Notwithstanding any damages you may incur, the Company's entire liability under these Terms and your exclusive remedy for any of the foregoing shall be limited to the amount actually paid by you through the Service. If you have not purchased anything through the Service, then the Company will not be liable to you under any circumstances. To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect or incidental damages (including but not limited to damages for loss of profits, loss of data or other information, for business interruption, for physical injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party computer programs and/or third-party computer equipment used with the Service, or related to the provisions of these Terms), even if the Company has been advised of the possibility of such damages and even if the compensatory legal remedy fails of its purpose.
Without limiting the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other computer programs, applications, systems or services, will operate uninterrupted, meet any performance or stability standards or be error-free or that errors or defects can or will be corrected.
Without limiting the foregoing, the Company makes no representations or warranties of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, materials or products contained therein; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability or timeliness of any information or content provided through the Service; or (iv) that the Service, its servers, content or e-mail messages sent by or on behalf of the Company will be free of viruses, computer languages, harmful computer code, harmful computer programs such as "worms, malware, time bombs" or other harmful elements.
Insurances
The Company does not have and will not have, and has not maintained insurance against all risks against which companies carrying on business and/or similar activities are usually insured, for the full replacement or replacement value of the business and assets and in particular has not had the insurance required by law, product liability and professional indemnity insurance.
Law in Force
These Terms and use of the Service shall be governed by the laws of the Republic of Albania, excluding its rules on conflicts of laws.
Resignation
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require performance at any time thereafter, nor shall a waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms
We reserve the right, in our sole discretion, to change or replace these Terms at any time. If a revision is material, We will use reasonable efforts to provide at least 30 days' notice prior to the effective date of the new terms. What constitutes a material change will be determined in our sole discretion. By continuing to access or use Our Service after such revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please discontinue use of the Website and the Service.
